NASCAR Files for appeal on 23XI, Front Row Preliminary Injunction,

23XI Racing and Front Row Motorsports have just won the first battle in a long lawsuit against NASCAR. The judge ruled in favor of them in the preliminary injunction, allowing them to sign the charter agreement and race chartered in 2025.

NASCAR is filing for an appeal on the injunction, asking the injunction to be delayed pending appeal. NASCAR will allow 23XI and FRM to have two cars in each race in 2025.

NASCAR Files For Appeal on Injunction Granting Charters in 2025

NASCAR has filed an appeal against the ruling of yesterday’s preliminary injunction. NASCAR is also filing an emergency stay of the injunction, pending the appeal. The sanctioning body will allow 23XI Racing and Front Row Motorsports to field two cars in every Cup Series race in 2025. But with no chartered benefits and no third charters from Stewart Haas.

Fox Sport’s Bob Pockrass shared the screenshot of NASCAR’s filing, with its reasoning as to why it should not grant the charter transfers;

NASCAR is asking for a ruling tomorrow on their request to delay the injunction, as the teams have sponsorship deals that need to be closed by December 20th. NASCAR is also asking the teams to post a bond, the amount was not shared, to cover payouts they might have to return if they lose the case.

23XI, Front Row win Preliminary Injunction, Will Race Chartered in 2025

The NASCAR world was shocked when one of its youngest teams, 23XI, and a smaller yet heavy hitter, Front Row, announced they had not signed the 2025 Charter Agreement. It continued to be shocked when they announced they had filed suit against the sanctioning body, claiming monopolistic practices and hired antitrust lawyer Jeffery Kessler.

This victory has been a long time coming. Let’s take a look back at the timeline of this lawsuit and its future.

September-October 2024: Lawsuit Proceedings Begin

On September 6th, 2024, NASCAR releases the new charter agreement. It sparked some controversy due to NASCAR requiring teams to sign it in under six hours or risk racing unchartered. All the teams signed, except for 23XI and Front Row. While some signed, they still were not happy with the agreement. Richard Childress said he had to look out for his employees, Rick Hendrick said they were just tired of arguing with NASCAR.

On October 2nd, 23XI and Front Row filed their antitrust lawsuit in federal court. They claimed that NASCAR’s monopolistic practices made it incredibly difficult to profit. The lawsuit also mentioned that NASCAR’s control over the tracks, the vendors that teams are forced to purchase parts from, and more reinforce NASCAR has monopoly over stock car racing in the United States.

November 2024: Court Proceedings Begin

Right after the penultimate race of the 2024 season at Martinsville, NASCAR and the two teams met in court. On November 4th, the judge heard preliminary arguments for the injunction. The judge ruling over the case was US District Judge Kenneth Bell. Initially, the judge ruled against 23XI/FRM. But would hear additional evidence of irreparable harm if the injunction was not granted.

Part of the evidence they provided to the judge was in the case of Tyler Reddick. In Reddick’s contract, he has a clause that he must race in a chartered racecar. So if preliminary injunction was not approved, Reddick and his sponsors would be free to leave 23XI. Monster Energy and its Beast Unleashed alcohol brand would be free to leave with Reddick and have him find a new home. Reddick won three races for the team just in 2024, a huge loss if he were to choose free agency.

With yesterday’s ruling, more information about the harm to the teams has been released. Adam Stern reported that Monster Energy was reconsidering its deal with 23XI and Love’s Travel Stops was also expressing concerns. Bubba Wallace reportedly told 23XI he needed to know immediately how 23XI intended to compete so he could weigh his options with other teams. Corey Heim also requested answers from the team, as he is the reserve driver for 23XI.

December 2024: Judge Rules in Favor of Preliminary Injunction

On Wednesday, December 18th, Judge Bell reversed the decision he made in November. This reversal will allow several big movements in the silly season to commence. The preliminary injunction will allow both 23XI and Front Row Motorsports to sign the 2025 charter agreement and proceed with their lawsuit. It also forces NASCAR to authorize the transfer of charters from Stewart Haas to both FRM and 23XI.

This guarantees cars for Tyler Reddick, Bubba Wallace, Riley Herbst for 23XI, Todd Gilliland, Noah Gragson, and a yet-to-be-announced Zane Smith. Charters guarantee spots in all races in 2025, including the clash and the all-star race.

NASCAR does have the opportunity to appeal to the US Court of Appeals, according to Bob Pockrass of Fox Sports, but it is not immediately clear if they will do so.

The Future Ahead:

While 23XI and Front Row have won this battle, there is still another to win. Court proceedings will seemingly resume following the 2025 season. Anything following the 2025 season, the charter agreement, and the transfer of the charters could be taken away. Assuming the teams win, we could see massive changes for teams and ownership in the future. If they lose, we could lose two titans of ownership, Michael Jordan and Denny Hamlin. Six drivers could be without rides and we could see a NASCAR changed forever.
