You can absolutely still sue FC Dallas despite signing a waiver saying you wouldn\u2019t.<\/p>\n<h2>In-Person Game COVID Concerns: You Can Sue Despite FC Dallas COVID Waiver<\/h2>\n<p>The <a href=\"https:\/\/lastwordonsoccer.com\/2020\/08\/12\/mls-is-back-final-portland\/\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">end of the MLS is Back tournament<\/a> also brought the end of MLS playing in a bubble. Now MLS begins a brand new experiment in trying to play games at teams\u2019 home stadiums (with the exception of <a href=\"https:\/\/www.hudsonriverblue.com\/2020\/8\/12\/21364054\/covid-montreal-impact-could-be-fourth-team-to-be-based-in-red-bull-arena-for-2020-mls-nycfc-nyrb\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">NYCFC and Toronto FC<\/a>). Wednesday\u2019s FC Dallas-Nashville game was the first MLS game to be played outside the bubble. It was also the first game that a <a href=\"https:\/\/www.texastribune.org\/2020\/08\/11\/fc-dallas-soccer-texas\/#:~:text=A%20maximum%20of%205%2C110%20fans,executive%20order%20governing%20sporting%20events.\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">limited number of fans were allowed to attend<\/a>.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Sports in 2020: the Lamar Hunt statue in front of Toyota Stadium wears a mask in addition to an FC Dallas scarf: <a href=\"https:\/\/t.co\/jShEw8homl\" target=\"_blank\" rel=\"noopener noreferrer\">pic.twitter.com\/jShEw8homl<\/a><\/p>\n<p>\u2014 Ian Thomas (@byIanThomas) <a href=\"https:\/\/twitter.com\/byIanThomas\/status\/1293716060085116930?ref_src=twsrc%5Etfw\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">August 13, 2020<\/a><\/p><\/blockquote>\n<p>Prior to attending August 12\u2019s FC Dallas-Nashville game at Toyota Stadium, <a href=\"https:\/\/dallas-mp7static.mlsdigital.net\/fc-dallas-spectator-waiver-online.pdf?PornadiIvz9F3p67nXPoPIHWYFWUtyOV=\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">fans were required to sign a waiver<\/a>. This agreement purportedly waived any right of fans to sue based on COVID.<\/p>\n<p>Typically, there are <a href=\"https:\/\/www.sadlersports.com\/riskmanagement\/sports-insurance-waiverrelease.php\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">two primary purposes<\/a> for a waiver or release agreement:<\/p>\n<p>1) To exculpate the company from claims from simple negligence.<\/p>\n<p>2) To provide evidence of the company\u2019s warning of inherent or other risks that can trigger an \u201cassumption of risk\u201d defense if the company is sued.<\/p>\n<p>The waiver provided by FC Dallas is a classic example of an over broad waiver of liability. The waiver also limits any legal against FC Dallas, Toyota Stadium, etc, however, to arbitration.<\/p>\n<h2>Terms and Conditions of FC Dallas COVID Waiver<\/h2>\n<p>The first thing the waiver spells out is what the person signing is receiving in return waiving their legal rights. <a href=\"https:\/\/lastwordonsoccer.com\/2020\/08\/13\/colorado-rapids-season-tickets\/\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">This is called the consideration<\/a>, and in this waiver the consideration is \u201cbeing permitted to enter and remain at <strong>Toyota Stadium<\/strong>.\u201d (emphasis in original).<\/p>\n<p>Section 1 of the waiver lists the risks the signer will assume by entering the stadium. The waiver notes that COVID-19 is \u201can extremely contagious disease that can lead to severe illness and death, and there is an inherent danger and risk of exposure to COVID-19 in any place where people are present.\u201d<\/p>\n<p>It goes on to say \u201cno precautions\u201d can eliminate the risk of exposure to COVID-19. This section ends in all caps \u201cI FULLY UNDERSTAND AND KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS RELATED TO MY ENTRY.\u201d<\/p>\n<p>Getting excited to attend a game yet?<\/p>\n<h2>Unenforceable Provisions of FC Dallas COVID Waiver<\/h2>\n<p>Section 2(A) is where it gets good:<\/p>\n<p>\u201c<a href=\"https:\/\/dallas-mp7static.mlsdigital.net\/fc-dallas-spectator-waiver-online.pdf?PornadiIvz9F3p67nXPoPIHWYFWUtyOV=\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">ON BEHALF OF MYSELF AND EACH OF MY RELATED PERSONS, I HEREBY KNOWINGLY, VOLUNTARILY, IRREVOCABLY, AND FOREVER RELEASE, WAIVE, AND DISCHARGE (AND COVENANT NOT TO SUE), EACH AND ALL OF THE RELEASED PARTIES FROM (OR WITH RESPECT TO) ANY AND ALL CLAIMS, SUITS, CAUSES OF ACTION, AND CLAIMS FOR DAMAGES, WHETHER PAST, PRESENT, OR FUTURE, AND WHETHER KNOWN OR UNKNOWN, INCLUDING, BUT NOT LIMITED TO, CLAIMS ARISING OUT OF OR IN CONNECTION WITH MY DEATH, PERSONAL INJURY, ILLNESS, DISABILITY, SUFFERING OF SHORT-TERM OR LONG-TERM HEALTH EFFECTS, OR LOSS OF OR DAMAGE TO PROPERTY, WHICH I OR ANY OF MY RELATED PERSONS MAY HAVE OR HEREAFTER ACCRUE AGAINST ANY OF THE RELEASED PARTIES AS A RESULT OF OR THAT RELATE IN ANY WAY TO (I) MY EXPOSURE TO COVID19<\/a>.\u201d<\/p>\n<p>To begin with, courts will not allow you to waive &#8220;any and all claims&#8221; against anybody. To do so would mean that you are also waiving any right to sue if FC Dallas or its agents\u00a0<strong>intentionally<\/strong> injure or infect you with COVID. <a href=\"http:\/\/www.courtswv.gov\/supreme-court\/docs\/fall1991\/20072.HTM\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">Courts have ruled that it is contrary to public policy to uphold contracts that waive liability as to intentional conduct<\/a>.<\/p>\n<p>Let&#8217;s say the FC Dallas board got together and nefariously decided to invite fans to the match to sit on needles placed in the seats of the stands infected with COVID. You are absolutely still able to sue FC Dallas for all their worth regardless of what you signed waiving &#8220;all&#8221; claims.<\/p>\n<p>Courts have allowed waivers of simple negligence, but anything above that is unlikely to hold much water. The FC Dallas COVID waiver is designed to do one thing. It is designed to scare people away from trying to pursue legal action at all.<\/p>\n<h2>The Arbitration Clause Of The FC Dallas COVID Waiver<\/h2>\n<p>The most important thing you are doing by signing this waiver is giving up your ability to participate in a class-action suit. Hand in hand with this is the agreement to pursue all legal action through arbitration. Such arbitration agreements <a href=\"https:\/\/www.fisherphillips.com\/resources-alerts-supreme-court-dims-the-light-on-class\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">have been upheld as valid by the courts<\/a>, despite their lopsidedness.<\/p>\n<p>These are the most important provisions of the FC Dallas COVID Waiver, because the only realistic way an attorney would take on any case trying to sue FC Dallas over COVID would most likely have to be through a class-action suit to generate enough funds for a law firm to take on the case and FC Dallas&#8217; high paid attorneys.<\/p>\n<p>So if you are infected by COVID, you can still sue. However, instead of seeing a judge, your suit will be decided in arbitration.<\/p>\n<p>What&#8217;s so wrong with arbitration?<\/p>\n<p>Many have found it is <a href=\"https:\/\/www.epi.org\/publication\/the-arbitration-epidemic\/\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">much more difficult to be successful in arbitration than in court<\/a>. This is due to the fact that arbitration lacks the same rules of due process afforded in court. It is also the corporation that gets to decide whether to include fairness protections in the arbitration procedure. You can absolutely still sue.
