It means that the second-year running back can take the field when his <a href=\"https:\/\/lastwordonprofootball.com\/nfl-teams\/cowboys\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">Dallas Cowboys<\/a> face the <a href=\"https:\/\/lastwordonprofootball.com\/nfl-teams\/49ers\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">San Francisco 49ers<\/a> this <a href=\"http:\/\/www.dallascowboys.com\/news\/2017\/10\/17\/6-days-sunday-d-law-looking-extend-streak-49ers-new-qb-more\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">coming Sunday<\/a>.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BREAKING: Ezekiel Elliott wins another temporary restraining order&#8211;this time from a NY federal judge. (@PrograsiveXPlus) <a href=\"https:\/\/twitter.com\/PrograsiveXPlus\/status\/920434607526473728?ref_src=twsrc%5Etfw\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">October 17, 2017<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<h1><strong>Ezekiel Elliott Gets Second Temporary Restraining Order, Will Play Sunday<\/strong><\/h1>\n<p>The ruling, made by U.S. District Judge <strong>Paul Crotty<\/strong>, gives Elliott another legal victory against the NFL. Five days earlier, <a href=\"https:\/\/www.sbnation.com\/2017\/10\/12\/16330764\/ezekiel-elliott-6-game-suspension-appeal-nfl-wins-cowboys\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">a federal appeals court sided with the league<\/a> in overturning a previous TRO granted in the state of Texas. Elliott still has yet to miss a single game this season due to suspension.<\/p>\n<p>What appears to be at issue and one of the fundamental factors in both sides&#8217; respective case is the idea of &#8220;fundamental fairness.&#8221; Crotty arrived at his favorable decision for Elliott in part due to his opinion that the league&#8217;s argument about the above notion not applying under the Labor Management Relations Act is &#8220;<a href=\"https:\/\/twitter.com\/WALLACHLEGAL\/status\/920444961665044480\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">quite wrong<\/a>.&#8221; This is in contrast to the appeals court injunction reversing the original TRO which said &#8220;fundamental fairness&#8221; didn&#8217;t apply.<\/p>\n<p>Tuesday&#8217;s decision certainly clears the way for Elliott&#8217;s return to the field on Sunday. But it may be short-lived. Crotty essentially deferred to judge <strong>Katherine P. Failla<\/strong> in whether or not to apply another preliminary injunction to this second restraining order. That could come as early next week, as Crotty&#8217;s ruling effectively expires a week from next Monday.<\/p>\n<p>For now, Elliott has a green light to participate in all team activities ahead of Sunday&#8217;s game. The NFL&#8217;s suspension essentially barred him from the Dallas facilities until its conclusion, which would&#8217;ve occurred after the Cowboys&#8217; Week 12 game against the <a href=\"https:\/\/lastwordonprofootball.com\/nfl-teams\/rams\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">Los Angeles Rams<\/a>. But he&#8217;s not out of the woods yet.
