{"id":2104,"date":"2016-09-21T12:41:54","date_gmt":"2016-09-21T16:41:54","guid":{"rendered":"https:\/\/lastwordonprofootball.com\/?p=2104"},"modified":"2021-03-13T12:44:23","modified_gmt":"2021-03-13T17:44:23","slug":"governor-sandoval-preparing-nevada-legislature-for-special-session","status":"publish","type":"post","link":"https:\/\/lastwordonsports.com\/nfl\/2016\/09\/21\/governor-sandoval-preparing-nevada-legislature-for-special-session\/","title":{"rendered":"Governor Sandoval preparing Nevada Legislature for Special Session"},"content":{"rendered":"<p style=\"text-align: justify;\">Last week the <strong>Southern Nevada Tourism Infrastructure Committee<\/strong> unanimously recommended the <strong>Raiders Stadium Proposal<\/strong>. The next step in the process is a stop at <strong>Governor Sandoval&#8217;s<\/strong> office. Both the <strong>Oakland Raiders<\/strong>, and the <strong>Las Vegas Sands Corporation<\/strong>, requested that Governor Sandoval call for a special session of the <strong>Nevada Legislature<\/strong>. Signs are pointing to the <strong>Raiders<\/strong> and <strong>Sand<\/strong>s getting their wish.<\/p>\n<h2 style=\"text-align: justify;\"><strong>Nevada<\/strong>\u00a0<strong>Governor\u00a0Sandoval<\/strong>\u00a0declared half a dozen seats in the <strong>Nevada Legislature<\/strong>\u00a0&#8220;Vacant&#8221; last week.<\/h2>\n<p style=\"text-align: justify;\">Not only that, but Governor Sandoval requested that those seats be filled by the counties they were in as soon as possible. This is pursuant to <strong>Article 4, Section 12<\/strong> of the <a href=\"https:\/\/www.leg.state.nv.us\/const\/nvconst.html\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Nevada Constitution<\/strong><\/a>, and <strong><a href=\"https:\/\/www.leg.state.nv.us\/nrs\/NRS-218A.html\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">NRS 218A.260<\/a><\/strong>. New appointments will only be in office until <strong>November 8th<\/strong>. After which, those who are duly elected will take office. Understand, there is no &#8220;lame duck&#8221; after the election in <strong>Nevada<\/strong>. Once Nevada Lawmakers\u00a0are elected, they take office immediately.<\/p>\n<p style=\"text-align: justify;\">The timing of these appointments is what is interesting here. Nevada Lawmakers concluded business for 2015 and 2016, last year. This effectively\u00a0opens the door for Governor Sandoval to call for a special session before the election.<\/p>\n<h3 style=\"text-align: justify;\">Governor Sandoval has a short time frame to call for a special session because of Nevada campaign contribution laws.<\/h3>\n<p style=\"text-align: justify;\"><em> If a special session is called, a legislator, governor, governor-elect, lieutenant governor and lieutenant governor-elect, may not receive or solicit a campaign contribution during the period beginning the day after the governor issues a proclamation calling for a special session and ending 15 days after the final adjournment of a special session. (<a href=\"https:\/\/www.leg.state.nv.us\/nrs\/NRS-294A.html\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\">NRS 294A.300;<\/a><\/em><em><a href=\"https:\/\/www.leg.state.nv.us\/nrs\/NRS-294A.html\" target=\"_blank\" target=\"_blank\" rel=\"noopener noreferrer\"> 294A.310<\/a><\/em><em>)<\/em><\/p>\n<p style=\"text-align: justify;\">The Election is <strong>November 8th<\/strong>. That leads me to believe that the Governor will announce special session during the last week of <strong>September<\/strong>. Coincidentally,\u00a0<strong>State Sen. James Settelmeyer<\/strong> moved his fundraiser from September 28th, to the 27th. Settlemeyer&#8217;s action,\u00a0might have clued us in on\u00a0when Governor Sandoval will call for a special session, September 27th.<\/p>\n<p style=\"text-align: justify;\">What does this all mean? Everything is lining up for there to be a special session of the Nevada Legislator in the first week of <strong>October<\/strong>. Lawmakers will then vote on\u00a0the Raiders Stadium Proposal. I have heard there are three possible out comes.<\/p>\n<p style=\"text-align: justify;\">First, lawmakers could decide with a 2\/3rds majority, in both houses, to increase the Hotel Tax by .88 percent. Under the second option lawmakers could authorize <strong>Clark County<\/strong> the authority to vote on the tax increase themselves with only a simple majority in both houses. This would still require five of the seven <strong>Clark County Commissioners<\/strong> to approve the proposal. Last, but not lease, the Legislature could vote down the proposal.<\/p>\n<p style=\"text-align: justify;\">If lawmakers pass the Raider Stadium Proposal, Clark County will then vote to adopt the proposal.
