According to this proposal by 2024, NY mobile betting is going to have sixteen sportsbooks instead of the current nine legal and licensed. This action alone is going to automatically lower the tax rate, which is currently at a sky-high 51% to half of that – 25%.
NY state mobile sports betting went through years of bills that didn't get accepted until last year when Gov. Andrew Cuomo finally accepted the upcoming change but insisted on the high rate of 51% tax in the Empire State. Now that Gov. Andrew Cuomo is out the rest of the lawmakers are hoping to re-shape NY mobile sports betting in a way that would be a lot more sustainable in the long term than this current model.
There are a few changes that are suggested in the proposal that you should be happy about:
- Tax exemption on all future revenue that comes from promotional wagers or free play.
- The 51% NY online sports betting tax to drop to 35% by 2023 by adding at least five more operators to the currently available nine licenses.
- Adding at least two more sportsbooks by 2024 will effectively drop the tax rate to 25%.
- Additional licenses for minority-owned sportsbooks get first dibs.
This proposal doesn't specify exact tax rates, so the NYS Gaming Commission could adjust them as necessary within the limits they have been provided. The final date until which the General Assembly has to agree upon the new budget for 2022 and 2023 is April 1st. Gov. Kathy Hochul hasn't said whether she is open or not to tweak the current NY sports betting bill, but her budget included three new downstate casinos, so everyone is more optimistic than with her predecessor in charge.

Could New Jersey's Handle Drop in February be New York's Fault?
Recently stats show that for February New Jersey's sports betting handle and revenue have dropped, but can we attribute that to New York's legal sports betting launching, or is the problem somewhere else?
New York isn't at fault here because February is the time when the NFL and NHL calendar have significant breaks. In January, the handle for all football events was reported to be $340.3 million, but a month later it dropped to $143.7 million. Other sports betting markets, like Iowa (28.8%), Tennessee (18.8%), and Indiana (18.2%) also saw significant declines after January this year, so it isn't happening only in New Jersey. Also, New York sports betting saw a 9% handle drop since it was legalized after a first full month.
Another statistic shows that sports betting in New Jersey for February are up 32.7% compared to last February. Some of you might say this is good, but compared to other states’ handle reviewed for February only, we see a significant drop. For example, the increase in handle since last February has increased in Iowa (+50.3%), Tennessee (+77.7%), and Indiana (+49.4%) by much more, as you see.
The upcoming March Madness could tell us a lot about whether or not New York's sports betting is the reason for the handle drop of New Jersey's revenue or the main reason is something else entirely.
Some people, like Sen. Joseph P. Addabbo Jr, believe that any discussion about lowering the tax rate is “premature” as he stated the large figures that will only go higher throughout March Madness will convince everyone that this is a good thing.

New York Continues to Break Handle Records by Betting $3.16 Billion
The New York State Gaming Commission released numbers that confirm the sports handle in the Empire State has reached three billion and counting since the start of legal betting in the state through the end of February. This means that for that period (January 8th – End of February) the total sports betting tax collected in the state equals $104.3 million.
FanDuel seems to be leading the charge in New York with their sports handle record of $1.07 billion since the launch through February 27th. If you aren't sure what “handle” means, it is the total sum people place on bets in a specific state and timeframe. The state legalized sports betting just in time for the Super Bowl and the playoff games beforehand. Now, they are also expected to see an increase in the handle because of March Madness.
For February itself, mobile operators paid more than $42 million in tax thanks to the sports betting handle for the month of around $1.528 billion in bets. Still, those numbers are considerably lower than the January figures we saw of $1.686 billion in handle for both mobile and retail sportsbooks in the state and $63.2 million in taxes.
